Purchaser: Please read the following General Terms & Conditions carefully. Your click or similar agreement binds you to the following terms and conditions for the sale.

THIS IS A CONTRACT AND YOUR PURCHASE OR PAYMENT OR ORDER PLACEMENT IS AN ACCEPTANCE OF THESE TERMS AND CONDITIONS.

DEFINITIONS:

“THOR GDG” is a shortened reference for THOR Global Defense Group, Inc. an Arkansas corporation which is the Seller herein.
“GT&C” refers to this document, the general terms and conditions.
“RAN” refers to a return authorization number.
“FFL” is a federally licensed firearms dealer (BATFE).
“FEL” is a federally issued license for the possession of explosives (BATFE)
“RFQ” is Request for Quote
“K-Code” ITAR Brokering License issued by the US State Department (DECCS)

GENERAL TERMS & CONDITIONS

The following General Terms & Conditions (GT&C’s) Apply to Purchases and Sales of Firearms by THOR Global Defense Group, Inc. (“THOR GDG”) in Transactions into the terms of which these GT&C’s are incorporated by reference. These terms and conditions are binding as if set out word for word in a contract for sale. If you disagree with or cannot meet any of the following terms and conditions then the contract cannot be fulfilled. These general terms and conditions constitute a contract between the Seller, and the customer, or Buyer. The Buyer accepts the sales agreement by making the purchase, placing the order, or otherwise shopping on our website or in our store. The terms and conditions of this sales agreement are subject to change without prior notice except those terms and conditions agreed upon at the time of purchase.

AGE AND IDENTIFICATION

You must be at least 18 years of age and legally allow to possess Articles of Defense to purchase ANY item from THOR GDG. THOR GDG reserves the right to request a copy of your government issued identification before processing any order. Seller reserves the right to request further forms of proof as to Buyer’s identification and age.

PURCHASING

THOR GDG fulfills orders by RFQ only. RFQ’s will receive a quote. Quotes will be valid only until the date of expiration listed on the quote. Brokers will be required to submit a K-code. Some products listed on the website are only available to government agencies and will require US Congressional approval to export.

CANCELLATION POLICY
Refunds and cancellations are subject to the following terms & conditions:

All sale items are final. THOR Elite Firing Range & Gun Club will only issue partial refunds.

30% non-refundable deposit
50% non-refundable deposit – (importing, forms submitted, etc.)
THOR Elite Firing Range & Gun Club will only issue a 50% refund if subsection (4) is the cause.
THOR Elite Firing Range & Gun Club will not issue refunds on custom or special orders.

All sale items are final and cancellation shall not be permissible. THOR Elite Firing Range & Gun Club will only issue a partial refund for a sale item if your transfer is denied pursuant to subsection (4) below. All other transactions shall be subject to subsections (2) through (5) immediately below.
Once THOR Elite Firing Range & Gun Club has received verification of purchase from Gun Broker, or received Payment for an order through our website, cancellation shall not be permissible, and no refund will be issued by THOR Elite. Non-Paying bidders will be reported to Gun Broker.
The time frame for BATFE to process and approve Class III transfer paperwork will fluctuate depending upon demand placed on BATFE. THOR Elite Firing Range & Gun Club does not control how long it takes BATFE to process transfer paperwork, and therefore, THOR Elite Firing Range & Gun Club is not responsible for any delays that may arise in BATFE’s processing and approval of the transfer paperwork. See subsection (B) regarding cancellation at this point.
Upon THOR Elite Firing Range & Gun Club filing your 4473 (NICS) or Form 4 and Form 21 (Class III), and BATFE notifies THOR that you are denied your transfer due to an FBI background check. See subsection (C). This policy does not extend to paperwork filed with the BATFE by another FFL or individual.
THOR Elite Firing Range & Gun Club will not issue a refund for a “Return without action” due to an inconclusive FBI background check. See subsection(C) Generally, inconclusive results are rare, but are often the result of incomplete information at FBI. THOR Elite Firing Range & Gun Club can assist with the resolution of an inconclusive FBI background check.
Cancellation of an item must be requested, by email info@thorranges.com prior to THOR Elite ordering a product from the manufacturer or filing the paperwork to transfer. Cancellation fees will apply. See subsection (A-C) Deposits will only be refunded if subsection (A-C) applies. Custom or Special orders will not be refunded. See subsection (D).

PAYMENT

THOR Elite will accept credit card payments for IN STOCK Non-Class III item only. Special orders, back orders, custom orders, and all Class III must be paid with cash, personal check, money order, cashier’s check or wire funds transfer.

All THOR GDG Terms and Conditions will apply to THOR Elite if not specified above.

INQUIRIES

Inquiries as defined by Merriam-Webster is a request for information. This includes but is not limited to phone calls, voicemails, emails. We, as a corporation, do not dictate the schedule of the manufacturer and no promises or covenants were made at the beginning of this relationship about the timing of the delivery of the order. As soon as the item arrives and/or is ready to leave our facility we will contact you with tracking information. Contacting us more than 2 times a week or more than 10 times in total will result in your order being canceled per our terms and conditions.

THOR GLOBAL DEFENSE GROUP – INTERNATIONAL SHIPPING

All orders are shipped as quickly as possible We regularly ship firearms and equipment via freight forwarder unless otherwise specified. Purchases will be placed in suitable packaging for shipping, the cost of which may be passed on to Buyer. Rush orders will be placed on top priority and will include rush fees. You may request that your package be insured for more than the standard carrier amount. This may delay your product’s arrival and will lead to additional charges.

EXCHANGE, REFUND AND RETURN POLICY

A NONREFUNDABLE 50% deposit is required on all orders. Balance is due upon inspection two (2) weeks prior to shipping. Failure to make the inspection within the two (2) week inspection time will lead to ineligibility for returns, exchanges, etc. If you have purchased a THOR weapon from a THOR Dealer, and are not satisfied, your FFL may request a RAN and the unfired gun may be returned with THOR GDG for exchange only. To return an item for exchange, customers must contact THOR GDG to receive a RAN, or return authorization number, to place on the outside of the box. All items without a RAN will be refused. THOR GDG is not responsible for shipping and insurance on exchanges. If you have not made contact with THOR GDG within Two (2) years from the date you place your order with THOR GDG, all orders will and shall be considered cancelled and all business completed unless specifically outlined in a separate agreement. Should you elect to cancel your order with THOR GDG and should you elect not to make an exchange as set forth hereinabove, you hereby agree and acknowledge your deposit will be considered forfeited and such will be retained by THOR GDG and treated as liquidated damages for your cancellation of such order. No Credit Cards can be used. For THOR Direct In-Stock Dealers, only check, money order or wire funds can be used. Our In-Stock THOR Dealers allow a Three-Day Inspection period on items. The weapons must stay with your FFL. There are absolutely no returns on loaded ammunition, explosives, powder or primers due to liability and insurance issues beyond our control. Please make sure you are buying exactly what you need.

COMPLIANCE

Compliance on orders will be billed at $250 an hour with a four (4) minimum. Any product placed on a Compliance Hold will not move until the hold has been satisfied and released.

STORAGE FEES

Once your product has arrived and been approved for transfer, one of our staff will notify you by email. You will be contacted no more than two (2) times in a thirty (30) day period to receive or pick up your product. Failure to receive or pick up your product after thirty (30) days will result in a storage fee of $10 a day per unit. Failure to receive or pick up your product after ninety (90) days will result in a Compliance Hold. Failure to receive or pick up your product after six (6) months will result in the forfeit of the product for storage and Compliance fees and the product will be resold. THOR is not responsible for your failure to receive notification if you change your phone number and/or email and fail to notify us.

FORCE MAJEURE

If THOR GDG is delayed in or prevented from performing, in whole or in part, any of its obligations under a transaction due to causes that are beyond THOR GDG’s reasonable control and without the fault or negligence of the party affected thereby (“Force Majeure”), and THOR GDG gives oral notice and full details of the Force Majeure to the other party as soon as reasonably practicable after the occurrence of the Force Majeure, then during the period for which THOR GDG’s performance is prevented by such Force Majeure but for no longer period, the obligations of such affected party under such affect transaction shall be excused to the extent performance is so prevented. It is understood and agreed that the current political climate has greatly delayed shipments from manufacturing plants and, thus, the time that will elapse between your order and THOR GDG’s shipment of such to you may be delayed significantly and that such delay shall not affect your agreement to pay for the firearms ordered and to be bound by these GT&C’s.

THOR GDG is not liable or responsible for any uncertainty created by the political climate.

THOR GDG is not liable or responsible for delays created or experienced by carriers such as the United States Postal System, United Postal Service, Federal Express, or
other like carriers.

EXPORTING

THOR GDG weapons are not to be exported without prior written approval from the company. An End Use Statement will be required along with a copy of export approval by the appropriate U.S. Federal agency. THOR Global Defense Group offers exporting services and will be more than happy to assist with exporting our product.

EXPLOSIVES – US DOMESTIC

THOR GDG will require a copy of your FEL at the time of your RFQ. The movement of explosives will only be with approved licensed freight.

MISCELLANEOUS

By purchasing from THOR GDG you agree to follow all manufacturer safety instructions and to use the firearm(s) in a safe manner and for legal purposes. By accepting these terms and conditions, you are hereby acknowledging:

1. You are responsible for checking all local laws before ordering an item from THOR GDG, or any manufacturer whose product is sold here;
2. You are responsible for complying with all firearm laws in your area and you are at least 18 years of age.
3. You are assuming all responsibility for the legality of a specific item(s) when you purchase it.
4. You are responsible for payment for all orders placed through this online system. If you do not want it, please do not order it.
5. You agree not to export your item out of the United States without following ITAR or EAR.

YOU MAY CANCEL YOUR ORDER AT ANY TIME BUT PLEASE BE AWARE THAT YOU WILL NOT BE REFUNDED THE 50% DEPOSIT. A 50% CANCELLATION FEE IS DUE ON ANY ORDER AT THE TIME OF CANCELLATION. Per State law, we are only able to discuss orders with the individual customer.

PRICE & DESCRIPTION ERRORS

All pricing is subject to change without notice. Seller reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements, and any other extenuating circumstances. Online inventory changes daily. We try very hard to make sure there are no errors. THOR GDG will not guarantee that titles, pictures, or descriptions on our site are error free. THOR GDG reserves the right to refuse any order including but not limited to orders for items with errors in the price or description. In the event that an order is canceled due to an error in the price or description, THOR GDG will not charge the customer and we will return funds in full if payment has been sent. THOR GDG reserves the right to delay refunds pending the validity of a transaction if made by wire or check. If a customer places an order that contains an error, THOR GDG will not process the order without first contacting the customer. If an order is mistakenly shipped, we may advise the customer to return the item in an unopened condition and we will not bill the customer. By placing an order with THOR GDG, the customer agrees that THOR Global Defense Group, Inc. will be the final arbiter of any discrepancies.

INTERNATIONAL CUSTOMERS

If any changes must be made with paperwork (DSP-83, END USER CERTIFICATE, etc.) customer may be responsible for a service charge of $500 per instance. Deposits and payments are NON-REFUNDABLE for international/export orders. Customer’s balance may be transferred to other items if product order is severely delayed or halted. If customer is denied export approval by ITAR or EAR, THOR Global Defense Group will notify the customer In writing as soon as possible. All payments made for international orders are 100% NONREFUNDABLE. Service charge may apply. All payments must be made via wire funds transfer. THOR Global Defense Group will contact the customer with date of which the two-week inspection period will begin. Balance on the order is due at the end of the two-week inspection time. No product will ship without being paid in full.

INTERNATIONAL FREIGHT

All orders are shipped as quickly as possible. We regularly ship firearms and equipment via freight forwarder unless otherwise specified. Purchases will be placed in suitable packaging for shipping, the cost of which may be passed on to Buyer. International Freight will be quoted upon the beginning of the two (2) week inspection time. Freight quotes are valid for thirty (30) days unless specified. Product will not ship without freight payment in full. Deposits on other invoices will not be used for freight. Freight is paid as final payment upon its direct invoice and the invoice MUST be paid in full prior to shipping. Once product is applied for export, no product replacement will be offered for the duration of the export approval without additional fees.

LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTY

This site is provided by THOR Global Defense Group, Inc. on an AS IS basis. THOR Global Defense Group, Inc. makes no warranties of any kind, expressed or implied regarding the operation of this site or the information, content or products appearing on this site. To the fullest extent permissible by law THOR Global Defense Group, Inc. disclaims all warranties expressed or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose and also such warranties for any merchandise offered on this site. This disclaimer does not apply to any product warranty offered by the manufacturer of any product sold on this site. In some jurisdictions limitation of liability are not permitted. In such jurisdictions some of the foregoing limitations may not apply to you. THOR Global Defense Group, Inc., its employees, officers, agents, and suppliers shall not be liable for any damages of any kind arising from the use of this site including direct, indirect, incidental, punitive, or consequential damages whether in contract, negligence or tort even if THOR Global Defense Group, Inc. knew or should of known of the possibility of such damages. Your use of this website is at your sole risk. If you are dissatisfied with the website or content of the site you are sold, the exclusive remedy is to discontinue using the site.

All products sold on this site are for adult use only and by ordering on this site you certify that you are of legal age and not prohibited from purchasing the products. Merchandise listed herein is not for sale in any state district of territory where the receipt, possession sale of use of any such merchandise is prohibited.

GOVERNING LAW AND CHOICE OF FORUM

EACH TRANSACTION AND THE RIGHTS AND DUTIES OF THE PARTIES ARISING THEREFROM SHALL BE GOVERNED BY AND CONSTRUED, ENFORCED AND PERFORMED IN ACCORDANCE WITH THE LAWS OF THE STATE OF ARKANSAS WITHOUT GIVING EFFECT TO PRINCIPLES OF CONFLICTS OF LAWS. EACH PARTY AGREES THAT IT WILL BRING ANY ACTION OR PROCEEDING IN RESPECT OF ANY CLAIM ARISING OUT OF OR RELATING TO ANY TRANSACTION, WHETHER IN TORT OR CONTRACT OR AT LAW OR IN EQUITY, OR BASED ON ANY STATUTE, REGULATION OR OTHER GROUND FOR RELIEF, EXCLUSIVELY IN THE UNITED STATES DISTRICT COURT FOR THE WESTERN DISTRICT OF ARKANSAS OR THE STATE CIRCUIT COURT LOCATED IN CRAWFORD COUNTY, ARKANSAS, VAN BUREN DIVISION (THE “CHOSEN COURTS”) AND (I) IRREVOCABLY SUBMITS TO THE EXCLUSIVE JURISDICTION OF THE CHOSEN COURTS, (II) WAIVES ANY OBJECTION TO LAYING VENUE IN ANY SUCH ACTION OR PROCEEDING IN THE CHOSEN COURTS, (III) WAIVES ANY OBJECTION THAT THE CHOSEN COURTS ARE AN INCONVENIENT FORUM OR DO NOT HAVE JURISDICTION OVER ANY PARTY HERETO AND (IV) AGREES THAT SERVICE OF PROCESS UPON SUCH PARTY IN ANY SUCH ACTION OR PROCEEDING WILL BE EFFECTIVE IF SERVICE IS PERFECTED, AS PROVIDED BY THE LAWS OF THE STATE IN WHICH SERVICE IS HAD.

IT IS THE INTENTION OF THE PARTIES TO THIS CONTRACT AND ALL SUITS AND SPECIAL PROCEEDINGS UNDER THIS CONTRACT, BE CONSTRUED IN ACCORDANCE WITH AND GOVERNED, TO THE EXCLUSION OF THE LAW OF ANY OTHER FORUM, BY THE LAWS OF THE STATE OF ARKANSAS, WITHOUT REGARD TO THE JURISDICTION IN WHICH ANY ACTION OR SPECIAL PROCEEDING MAY BE INSTITUTED.

SEVERABILITY

IF ANY TERMS OR PROVISION OF THIS AGREEMENT ARE DETERMINED TO BE INVALID OR UNENFORCEABLE BY A COURT OF COMPETENT JURISDICTION, THE REMAINDER OF THIS AGREEMENT WILL NOT BE AFFECTED AND EACH UNAFFECTED TERM AND PROVISION OF THIS AGREEMENT WILL BE VALID AND BE ENFORCEABLE TO THE FULLEST EXTENT PERMITTED BY LAW.

HEADINGS

HEADINGS ARE INSERTED FOR THE CONVENIENCE OF THE PARTIES ONLY AND ARE NOT TO BE CONSIDERED WHEN INTERPRETING THIS AGREEMENT. WORDS IN THE SINGULAR MEAN AND INCLUDE THE PLURAL AND VICE VERSA. WORDS IN THE MASCULINE GENDER MEAN AND INCLUDE THE FEMININE GENDER AND VICE VERSA. WORDS IMPORTING PERSONS INCLUDE FIRMS AND CORPORATIONS AND VICE VERSA.
